Terms and Conditions

The following Terms and Conditions apply to all transactions on this website, please read them carefully and print a copy for future reference.

Sales on this website are governed by English law and you agree to submit any dispute to the exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions, and we will not accept any amendments.



PRODUCTS
The product descriptions are accurate and up-to-date. There may be slight variations in the images of products provided. Colour Charts featured on the site should be used for guidance only in conjunction with the written descriptions. Due to the nature of color calibration, the colours on your monitor may differ from the actual product. All weights and measurements are approximate.

We cannot be held responsible for reactions or sensitivity caused by products purchased from us. Please follow manufacturers instructions before using any product.
When purchasing products you should be sure they are suitable for your own particular use as refunds cannot be made if they prove not to be.
Special Offer and Clearance items are not covered by our full refund policy unless faulty, except where this has been pointed out prior to sale.

For unboxed items or testers, the price of the equivalent regular goods may be shown for reference only. Testers are the regular products in a bottle/packaging and marked "Tester". These items are sold so that you can make even greater savings on the fragrances you love.

Some items may also be marked "Not for Individual Sale".
By submitting your order, you are confirming that you are aware of this fact and do not have a problem with ordering that product.
We make every effort to ensure all products marked as such are identified on the system.

Availability of products is not guaranteed. All products come with a money back guarantee.



YOUR RIGHTS
There will be a binding agreement between 'you' and 'us' once we notify you by email that we have received your order.

You have the right to inspect the goods and return the order within 7 working days of receipt. If we do not hear from you within 14 days we shall deem that the goods are of a satisfactory condition and are fit for purpose, which will lead to you being unable to return or reject the goods at a later date. This does not affect your statutory rights.

If the goods were faulty at the time of delivery or the goods are not what you ordered you will be eligible for a full refund. This does not affect your statutory rights.

If you are charged for an item which is out of stock, we will refund the cost of the item or it can be delivered to you free of charge when it is back in stock.

Most of our items are brand new. If the items are in any way damaged , unboxed or marked "TESTER", "Gift With Purchase" or "Not for Individual Sale" this will be dispayed on our listing. We will not refund items that are sold as damaged, or old stock quality if stated in the listing.



CANCELLATION AND REFUNDS
You have 7 days to cancel an order. But if the order has been sent you must return the goods and pay the delivery costs.

We make every effort to ensure that all prices are accurate, Should we discover an error in the prices of goods ordered we will email you as soon as possible, giving you the chance to reconfirm at the correct amount.

We will cancel the order if we are unable to contact you. If you cancel the order, we will give you a full refund as long as we have not dispatched the order.
We reserve the right to refuse a refund and if goods are received in an unsatisfactory condition we will give a refund. You will then be liable for all costs to have the goods sent back to you. If these costs are not met within 30 days then we shall dispose of the goods.

If the order was delivered free of charge we shall deduct our post & packing fee from the final refund amount.



RETURNS
Should the goods reach you in a damaged or faulty condition please report this to us by email within 2 working days of receipt. Our stringent stock/dispatch controls which are used when processing your order can be accurately checked and you will be required to return faulty/damaged goods unused and in their original packaging to us in order to make a claim.
You must contact us by email to confirm the goods being returned.

Please return the goods by 2nd class post (please obtain Proof of Posting), you are liable for the cost of returning the goods. There will be no refund of the cost of returning the goods. Any free gifts associated with an item must be returned at the same time.

Claims will not be processed until items have been returned even during seasonal busy periods where the goods may have been ordered as a gift. You will also be required to complete and sign a claims form which will be forwarded to Royal Mail for investigation.



COMPLAINTS
We are sure that you will be happy with your purchase, but should you wish to cancel your order please email within 7 working days of receipt.
To make a complaint please contact us by email at info@afrofreshuk.com.
Please ensure when contacting us that you provide your order number, Name, address, Phone number and STATE the nature of your complaint.
We can only to resolve complaints if we are supplied with all the information that we may require.
We will keep customers informed of the complaints process. We will keep you informed by email when the said complaint has been resolved or if there has been a change to the complaints process.
We aim to resolve complaints as quickly as possible and within 15 working days.



OUR RIGHTS AND RESERVATIONS
We reserve the right to decline any order. We will refuse orders from customers who do not abide by our trading terms.

We will change prices or to make changes to the website at any time and without notice.

We WILL NOT be held responsible for any delays caused during periods of ROYAL MAIL postal strikes.

We will pass details of any attempt to defraud us to the Police.

THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000
We will provide clear information about our products and services before purchase.

We will provide a written confirmation of order following purchase, by a confirmation email, a contract will only be entered into when we send you written acknowledgement of your order.

Under the above regulations, your obligations are as follows:
You should contact us in writing to notify of the intent to cancel the order. Cancellations will not be accepted if we have not been notified in writing. Email is an acceptable way to notify us and we will confirm receipt. If an order is cancelled but has already been dispatched, we would expect the goods to be returned to us but if we are required to collect the goods a collection charge will be deducted from the refund total.
The regulations impose a responsibility on the customer to take reasonable care of any goods that have been supplied. This obligation applies before and after written notice of cancellation/return has been given. The items should be suitably packed for return and sent by trackable means. If we receive goods for refund that are not saleable as new then we are entitled, by law, to seek recompense.

If you wish to return an item, it may be returned up to 14 days after delivery date. Goods received after this time are not refunded.



SECURITY OF PERSONAL INFORMATION
We use secure servers to ensure that all details are encrypted on your browser whenever you enter credit card information on the Afrofresh website. The servers are physically secured in a dedicated data centre.

Information is collected by our secure payment partner is PAYPAL who uses 128 bit SSL to encrypt its data. Transactions are made via PAYPAL who have their own terms and conditions. In the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party gains unauthorised access to any data you provide when accessing or ordering from our website.
